August 25, 2011 /24-7PressRelease/ -- Lisa Marie Vari, Managing Attorney at Vari & Associates, LLC, a Miami family law firm is honored to be selected as the Vice-President of the Florida Military Legal Consortium (FMLC), a community based partnership with the Army OneSource program.
Miami Family Law Attorney, Lisa Marie Vari, has been named as the Vice President of the Florida Military Legal Consortium (FMLC).
"I am honored to have the opportunity to work with a team dedicated to assisting Florida's military families with their legal needs. Servicemen and women fight every day to protect our freedoms overseas, the legal community needs to protect the legal rights of these brave people on the home front." said Attorney Vari.
In Florida, sixty percent of troops are from the National Guard and Reservists. These military personnel lack many of the services that are available in regular military installations. The FMLC is designed to fill the void in legal services not available to Florida's military personnel. The FMLC program is open to all branches of service and to servicemembers of all eras including active duty, retired military, veterans, Reservists and National Guard.
Thirty-five percent of all Florida military personnel are currently in need of legal services. "One of the biggest legal challenges for military personnel is in the area of family law. The FMLC is privileged to have a highly regarded family law attorney like Attorney Vari to assist us in developing a program to meet this challenge," said Candace Chewning, the South Florida Community Support Coordinator for Army OneSource.
Frequent and repeated deployments to Iraq and Afghanistan are increasing the divorce rates according to the Defense Manpower Data Center at the Pentagon. The divorce rate for active duty servicemembers has grown to 3.6 percent over the past decade. Parents also face emotional and legal turmoil when they are deployed overseas for military duty.
The recent addition of the Florida "Assignment of Timesharing Due to Military Service" statute has alleviated some of the concern for parents who are deploying overseas. The statute allows a parent who is activated, deployed or temporarily assigned on orders in excess of ninety days to designate a person(s) to exercise their child custody rights on behalf of the parent when their service materially affects their time-sharing. The person designated to exercise the military parent's time must be a family member, stepparent, or relative of the minor child(ren) by marriage.
But, the statute designed to help Florida military servicemembers has now created its own unique legal problems when grandparents or others exercising custody rights during the parents' deployment refuse to give up those rights once the servicemember has returned home. Attorney Lisa Vari and the FMLC hope to be able to help with these and the many other legal issues facing Florida's military personnel.
